PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus, calling for the records of the 3rd respondent's impugned order dated 25.07.2022 vide impugned proceeding in letter No.Vu/ Po/ E.Pa/ KaKa.Nagar East/ Ko.229-025-1082/ D-138/2022 and quash the same and further issue necessary direction to the respondents 1 to 4 for issuance of new Electricity Service connection based on the application dated 28.09.2021 vide., Application Reference Number 200092290921601 to the petitioner's property bearing old survey No.114/1 and New Survey No.5/1, Thiruvalluvar 1st Street, Nesapakkam, Chennai-600 078 in the name of the petitioner.

The challenge in this Writ Petition is the impugned order dated 25.07.2022, passed by the 3rd respondent and further to issue necessary direction to the respondents 1 to 4 for issuance of new Electricity Service connection in the name of the petitioner, based on the application dated 28.09.2021 to the petitioner's property morefully disclosed in the prayer to this Writ Petition.

2.It is the case of the petitioner that citing the reason that the vendor of the property now purchased by the petitioner was involved in the theft of electricity, the respondents refused to grant electricity connection and hence, he has come out with the present Writ Petition.

3.Learned counsel for the respondents 1 to 4 submitted that pending this Writ Petition, the respondents 1 to 4 have provided temporary electricity connection to the petitioner. It is also stated that already appropriate legal proceedings have been initiated to recover theft of electricity from the petitioner's vendor and therefore, once the building under construction of the petitioner is completed, they would provide the permanent electricity connection to the petitioners.

4.Such being the case, recording the submission made by the learned counsel for the respondents 1 to 4, once the petitioner has completed the construction of the building and if any application is given for changing temporary electricity connection into permanent, this Court directs the respondents 1 to 4 to consider the said application in favour of the petitioner.
