ORDER

This Criminal Original Petition has been filed to direct the respondent police to investigate the case in Crime no.138 of 2021 to file the final report to the concern Magistrate.

2. The learned counsel appearing for the petitioner would submit that despite the F.I.R. has been registered in Crime No.138 of 2021, the investigation has not been completed and final report has also not been filed.

3. Mr.N.Muthuvel, learned Government Advocate (crl.side) appearing for the respondent would submit that this is a case of theft in dwelling house. Though the respondent police has taken every steps to secure the accused, the identity of the accused is not established.

4.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (crl.side) appearing for the respondent.

5. This Court is of the view that when the accused is not detected, there cannot be a direction to file the final report immediately. However, the respondent police is directed to expedite the investigation and file the final report.

6. With the above direction, this Criminal Original Petition is disposed of.
