This petition has been filed to withdraw and transfer the HMOP No.42 of 2022 pending before the Sub Court, Attur, Salem District, to the Sub Court, Udumalaipet, Pollachi District.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. It is seen from the records that the respondent filed HMOP No.42 of 2022 on the file of the Sub-Court, Attur, for divorce. Now the petitioner working at Sainik School, Udumalaipet along with her child. Further the respondent also willing to live with the petitioner.

4. Considering the above, this Court is inclined to transfer HMOP No.42 of 2022 pending on the file of the Sub Court, Attur, to the file of the Sub Court, Udumalpet. Further the distance between Udumalaipet and Attur is nearly about 250 Kilometers.

5. Accordingly, the present Tr.C.M.P. is disposed of and the HHMOP No.42 of 2022 , pending on the file of the Sub Court, Attur, is withdrawn and transferred to the file of the Sub Court, Udumalaipet. Further the Sub Court, Attur, is directed to transfer the records in connection with HMOP No.42 of 2/4

2022, to the file of the Sub Court, Udumalaipet, within a period of three weeks from the date of receipt of a copy of this order and concerned Court is directed to dispose the case as expeditiously as possible preferably within three months. Further, both the parties are directed to appear before the Sub Court, Udumalpet, on 10.04.2023 for mediation not less than three sittings. No costs. Consequently connected Miscellaneous petition is closed.
