O R D E R
(Order of the Court delivered by S.M.SUBRAMANIAM) The order sought to be modified in the present Civil Miscellaneous Petition is order dated 30.09.2008 passed in O.S.A.No.189 of 2006.
2. The respective learned Senior Counsel appearing on behalf of parties to lis would submit that they have no serious objection with reference to the order passed by this Court on 30.09.2008. However, learned Senior Counsel appearing on behalf of appellant would contend that the discharge application in Application No.69 of 2020 is to be taken up at the first instance for the purpose of crystallizing the rights of the parties.
3. However, the issue relating to hearing of discharge petition is not the challenge in the present original side appeal. That being so, all such arguments may be advanced between the parties in the insolvency Page Nos.2/4
proceedings which is pending for about 19 years.
4. In view of the facts and circumstances of the case, it is for the respective parties to lis would urge the Court to take up the matter as expeditiously as possible.
With this observation, the Civil Miscellaneous Petition stands disposed of.
