The petitioner who was apprehends arrest at the hands of the respondent police for the offences under Sections 8(c), 20(b) (ii)(A), 27(a), 22(a) of Narcotic Drugs and Psychotropic Substance Act, 1985 in Crime No.34 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 17.01.2023, based on a secret information, the respondent police went to the spot and out of 4 person, 2 persons escaped from the spot on seeing the police party and the other 2 person were caught hold by the police from whom 190 orange tablets and 18 white tablets and Dispo Van 5 ml insulin were recovered. Further, dry Ganja leaves, flowers and stems were also recovered from them. On enquiry, it was found that the persons who had escaped from the place were one Naveen and Ranjith kumar/the petitioner herein. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case based on the confession of arrested accused. Hence, he prayed for grant of anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. The learned Government Advocate (Crl. Side) appearing for the respondent police vehemently opposed for grant of anticipatory bail to the petitioner stating that the chemical analysis report has been received and that the petitioner has got two previous cases out of which, one is for Gambling registered in Crime No.169 of 2022 and the another case is for the similar offence under NDPS Act registered in Crime No.683 of 2022. 5.Considering the nature of offence and bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
