ORDER
The petitioner/wife seeks transfer of FCOP No.399 of 2024 from the file of Principal Family Court, Erode to the file of Family Court at Vellore.
2. Heard the learned counsel for the petitioner as well as the 1/4
respondent.
3. The respondent/husband has filed FCOP No.399 of 2024 for dissolution of the marriage between the petitioner and the respondent. The petitioner/wife has expressed her inconvenience and difficulties in travelling 370 kms from her place of residence to attend the hearings at Erode.
4. Considering the inconvenience expressed by the petitioner and also as repeatedly held by the Hon'ble Supreme Court that convenience of the wife has to be given paramount consideration. I am inclined to transfer FCOP No.399 of 2024 from the file of Principal Family Court. Erode and transfer to Family Court, Vellore.
5. Accordingly, the Tr. C.M.P. No.98 of 2025 is allowed and FCOP No.399 of 2024 withdrawn from the file of Principal Family Court at Erode and transfer the same to Family Court, Vellore,
6. The Principal Family Court, Erode is directed to send the entire records relating to FCOP No.399 of 2024 to Family Court, Vellore forthwith. 2/4
7. The respondent/husband's physical presence shall not be insisted upon by the Family Court, Vellore except for the hearings when it is absolutely necessary.
8. It is made clear that the respondent/husband has not admitted to any of the allegations made in the affidavit filed in support of the transfer petition. The parties are at liberty to ventilate all their grievances before the Family Court, Vellore.
