This writ petition has been filed for issue of writ of mandamus directing the respondent to deal with the application submitted by the petitioner dated 05.06.2024, wherein, the petitioner has sought for survey and demarcation of the boundaries.
2.Heard Mr.J.Titus Enock, learned counsel appearing on behalf of the petitioner and Mr.M.R.Gokul Krishnan, learned Additional Government Pleader appearing on behalf of the respondent.
3.The petitioner is claiming title to the subject property by virtue of a registered Settlement Deed dated 10.02.2016 that was executed by the father of the petitioner. The petitioner is also placing reliance upon Patta No.444 which stands in the name of the grandfather of the petitioner. The petitioner wanted a survey to be conducted in the subject property for demarcation of the boundaries and in order to enable the petitioner to apply for a separate patta in his favour pursuant to the Settlement Deed executed in his favour. Since the application was not acted upon, the present writ petition has been filed before this Court. 2/4
4.Taking into consideration the facts and circumstances of the case and considering the documents placed before this Court and taking note of the limited relief sought for by the petitioner, there shall be a direction to the respondent to deal with the application dated 05.06.2024 and conduct a survey in the subject property. If there is any rival claim, such survey shall be conducted in the presence of the rival parties. This process shall be completed, within a period of four weeks from the date of receipt of copy of this order. 5.This writ petition is disposed of with the above directions.
