Respondents Prayer: Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Declaration, declaring that the course, namely, Diploma Course in Pre-Primary (Kinder Garden) Teacher Training conducted by the Tamil Nadu Open University is a recognized course under the Tamil Nadu Private School Regulations Act in so far as the petitioner is concerned who has completed course in the academic year 2005-2006 and consequently, directing the respondents 1 and 2 to take steps to appoint the petitioner who has successfully undergone Diploma course in Pre Primary (Kinder Garden) Teacher Training conducted by the Tamil Nadu Open University in the academic year 2005-2006 recognized by the 3rd respondent as Junior Grade Teacher for Class I and II in any one of the Government Primary Schools/Aided schools.

O R D E R

The Writ Petition has been filed seeking to issue a Writ of Declaration, declaring that the course, namely, Diploma Course in Pre-Primary (Kinder Garden) Teacher Training conducted by the Tamil Nadu Open University is a recognized course under the Tamil Nadu Private School Regulations Act insofar as the petitioner is concerned who has completed the course in the academic year 2005-2006 with a consequential direction, directing the respondents 1 and 2 to take steps to appoint the petitioner who has successfully undergone Diploma course in Pre Primary (Kinder Garden) Teacher Training conducted by the Tamil Nadu Open University in the academic year 2005-2006 recognized by the 3rd respondent as Junior Grade Teacher for Class I and II in any one of the Government Primary Schools/Aided schools. 2.Heard the learned Counsel for the petitioner and the learned Government Advocate appearing for the respondents 1 and 2.

The prayer in the writ petition has become infructuous. The reason being that the request of the petitioner to appoint him as a Junior Grade Teacher for Class I and II in any one of the Government Primary Schools/Aided schools has to be considered only by the competent authority, namely, the Teachers Recruitment Board as per the latest qualification fixed by the Government. Therefore, due to the passage of time, nothing survives in the Writ Petition.

In the result, the Writ Petition is dismissed as infructuous. No costs.
