CHANDRASEKHARAN CRIMINAL MISCELLANEOUS PETITION No.2999 of 2022 IN CRL.A.No.215 OF 2017 V.NALLAMUTHU [PETITIONER/APPELLANT] Vs THE STATE REP BY ITS [RESPONDENT] INSPECTOR OF POLICE, VIGILANCE AND ANTI CORRUPTION CELL, CUDDALORE. (IN CRIME NO.8/2009) Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed that the petitioner shall appear before the said Court on the first working day of every month at 10.30 AM order passed in Crl MP No.5266/2017 in C.A.No.215/2017 as appearance of the Petitioner/Appellant is required till the disposal of the above C.A.No.215/2017and thus render justice.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.M.PALANIMUTHU, Advocate for the petitioner and of M/S. RAJ THILAK, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This petition is filed to modify the condition imposed on the petitioner by order dated 13.04.2017 in Crl.M.P.No.5266 of 2017 in Crl.A.No.215 of 2017 to appear before the learned Special Judge-cumJudicial Magistrate Court, Cuddalore on the first Monday of every English Calendar month at 10.30 a.m until further orders.

2. Learned counsel for the petitioner submits that the petitioner is complying with the condition imposed by this Court regularly except during the lock down period and therefore, has filed this petition, seeking to modify the condition imposed by this Court.

3. Heard the learned Additional Public Prosecutor and he also submits that the petitioner has been complying with the condition regularly except the lock down period.

Considering the fact that the petitioner is aged about 73 years and he is regularly complying with the condition imposed by this Court, the condition imposed by this Court is modified to the effect that the petitioner shall appear before the Special Judge-cumJudicial Magistrate Court, Cuddalore at 10.30 a.m on the first working day of once in three months of English Calendar month, commencing from 01.04.2022 until further orders. 5.The petition is ordered accordingly.
