..Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the concerned records from the respondents, quash the order of the 1st respondent bearing No.A&R - 18, dated 07.10.2008 and the order of the 2nd respondent dated 04.06.2008 and consequently direct the respondents to reinstate the petitioner in service with full backwages, continuity of service and all other attendant benefits, award costs. J U D G M E N T
The writ petitioner challenges the order of dismissal from service. He was working as a Field Officer under the respondents and for some certain irregularities charges were framed and the departmental proceedings that culminated in the order of dismissal. Even though, he challenged the order of dismissal on various grounds, when it is taken on final hearing, https://hcservices.ecourts.gov.in/hcservices/
the learned counsel for the petitioner would submit that he does not want to go into the merits of the case, but requires reconsideration of his representation to be made before the respondents for modification of the punishment. The learned counsel further seeks a direction to be issued to the respondents to consider the same within a specified time.
2. Even though the petitioner had sought for a larger relief now restrict it to consideration of his representation sympathetically. Without going into the merits of the case, a direction is given to the respondents to consider the representation for modification of the punishment and pass orders either accepting it or rejecting it at their discretion within a period of eight(8) weeks from the date of receipt of a copy of this order. No costs.
