ORDER

The petitioner, apprehends arrest at the hands of the respondent police for the offences punishable under Section 4(1)(aaa) read with Section 4(1-A) of the Tamil Nadu Prohibition Act, in Crime No.23 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that on the date of the alleged occurrence, the petitioner was found in illegal possession of 110 litres of liquor and the same was recovered by the respondent police. Consequently, the respondent police registered the present case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner is willing to cooperate with the investigation and undertakes to abide by any stringent conditions that may be imposed by this Court. On these grounds, he seeks the grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police vehemently opposed the grant of anticipatory bail. She submitted that the contraband was seized from the accused and highlighted that the petitioner is a habitual offender with four previous cases of a similar nature pending against him. She further contended that as the investigation is still in its preliminary stages and there is a likelihood of petitioner indulging in similar offence.

5. This Court, after carefully considering the rival submissions and the facts of the case, noting that the petitioner has four previous cases of a similar nature and there is a likelihood of petitioner indulging in similar offence, I am

not inclined to grant the relief of anticipatory bail.
