Ms.J.R.Archana Government Advocate (Crl.side) Order The petitioners, who apprehend arrest by the respondent police for the offences punishable under Sections 326(a), 303(2) of BNS, 2023 in Crime No.488 of 2025 registered on the file of the respondent police, seeks

anticipatory bail.

2. The allegation against the petitioners is that they, along with other accused, were involved in illegally removing sand from Government poramboke land and were caught red-handed. Hence, a case has been registered.

3. The learned counsel appearing for the petitioners submitted that they were engaged by a contractor only for cleaning purposes and that they merely cleaned the premises. He further submitted that the petitioners did not remove any sand. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioners were involved in illegally removing sand from Government poramboke land and that the photographs produced by the petitioners themselves are sufficient to show that the tractor was carrying sand. He further submitted that earth-moving equipment was used for removing the sand and that the investigation is still pending Hence, he opposed the grant of anticipatory bail to the petitioners.

5. Considering the nature of the allegations and the manner in which the occurrence took place, this Court is of the view that custodial investigation of the petitioners are very much necessary and, therefore, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition is dismissed. 04-02-2026 DRL
