Respondents Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of certiorarified mandamus calling for the records relating to the impugned order passed by the 2nd respondent dated 12.01.2018 in his order No.E-27099/36/13 [Part-3]/Vol.12/2000/Estt/H-783 and quash the same and to direct

the respondents to refund the sum of Rs.1,29,644/- collected illegally and order stepping up of pay with effect from 1999 and revise the pension and pay the arrears.

ORDER

(1)The learned counsel for the petitioner, after some arguments, realised that the order impugned dated 12.01.2018 does not speak about the recovery. Therefore, the alleged recovery said to have been made from the petitioner by the respondents cannot be challenged by challenging the present impugned order. Therefore, he wants to withdraw the present writ petition with liberty to work out his remedy by filing an appropriate writ petition if he is advised to do so in the manner known to law. (2)Recording the said submission of the learned counsel for the petitioner, this writ petition is dismissed with the said liberty. No costs.
