O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 303(2), 324(2), 329(4), 109(1) of BNS, 2023 read with Section 3 of Tamil Nadu Property ( Prevention of Damage and Loss) Act, 1992 in Crime No.01 of 2026, on the file of the respondent Police, seeks anticipatory bail.

The allegation against that the petitioner joining hands with three other accused trespassed into the rooms of the defacto complainant and three others and attacked them using deadly weapons and caused injuries and also taken away a sum of Rs.1,20,000/- and cellphones worth about Rs.15,000/- and damaged the rooms. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and his name is not mentioned in the FIR. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner. 2/5

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are four accused in this case and the petitioner is A4 and further submitted that, injured persons discharged from the hospital, however the injuries are severe in nature and also submitted that so far no money and property also not recovered. Hence, he opposed for grant of bail to the petitioner.

5. Considering the manner in which the occurrence had been taken place and the nature of injuries sustained by the victims in this case and also the fact that no money is recovered and also the fact that the petitioner also actively participated in this case, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 06.02.2026 sma 3/5
