PRAYER:

Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of certiorarified mandamus, to call for the records ending with the order of 3rd respondent made in proceedings No.Rc.No.F3/WP 26552/2006, dated 22.12.2008 and consequential order of 3rd respondent made in proceedings C.No.F3/WP 26552/2006 dated 6.2.2009 and to quash the same and consequently direct the respondents to reinstate the petitioner to duty by treating the absence from duty of the petitioner from 21.12.1986 till date of joining duty on reinstatement as duty for all purposes.

O R D E R

When the matter is taken up for hearing, the learned counsel for the petitioner submitted that during the pendency of the writ petition, the petitioner passed away. But, so far the legal representatives of the deceased petitioner have not given any instructions to substitute them. Hence, the writ petition is dismissed as abated. No costs.
