This Criminal Original Petition is filed under Section 482 of Criminal Procedure Code to direct the respondent police to alter the offence under Sections 279 & 337 IPC, Sections 134(a) & 134(b) of Motor Vehicle Act 1988 and to include the section 199A of the Motor Vehicles Act 1988 (Act 59 of 1988) as amended by Motor Vehicles (Amendment) Act 2019 in Crime No.92/2020 and file a fresh FIR.

O R D E R

This Criminal Original petition has been filed seeking for a direction to the respondent police to alter the First Information Report.

The learned Additional Public Prosecutor, on instructions, submitted that the FIR was registered only on 24.10.2020 for offences under Sections 279 and 337 of IPC and Section 134(a) and 134(b) of Motor Vehicles Act, 1988. The investigation is in progress. If in the course of investigation, the respondent police collect sufficient materials, the offenses will be altered accordingly.

In view of the above submissions, there shall be a direction to the respondent Police to continue with the investigation effectively and based on the materials collected during the course of investigation, either alter the FIR or file the final report by adding the necessary offences made out. https://hcservices.ecourts.gov.in/hcservices/

4. This Criminal Original Petition is disposed of accordingly.
