ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.01.2026 for the alleged offence punishable under Sections 123, 275 of BNS r/w Section 7(1), 20(2) of Cigarette and other Tobacco Products Act, 2003 in Crime No.4 of 2026, on the file of the respondent police, seeks bail. 1/4

2.The allegation against the petitioner is that he was involved in the possession of 503.550 kgs of banned Tobacco Products, which were allegedly transported from the State of Karnataka to Tamil Nadu with the help of an Eicher lorry. The said contraband was seized by the respondent police, pursuant to which, the present complaint has been registered and the petitioner was arrested. 3.The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner has nothing to do with the alleged offence foisted against him. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the contraband was seized from the petitioner and that he had illegally transported the same from the State of Karnataka to Tamil Nadu. He further submitted that though the petitioner has no previous cases pending against him, the investigation is still pending. Hence, he opposed for grant of bail to the petitioner.

5. Considering the nature of the allegations, the quantity involved in this case, the fact that the contraband was illegally transported from the State of Karnataka to Tamil Nadu, and that the petitioner was arrested only recently, this Court is not inclined to grant bail to the petitioner. 2/4
