ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.01.2026 for the alleged offence under Sections 123,110 of BNS in Crime No.17 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused mixed the tapentadatol tablets in the saline water and injected the same to the victim which resulted in causing severe health issues and immediately he was taken to the hospital and subsequently a complaint was lodged by the wife of the victim. Thereafter, the respondent police seized 260 numbers of tepentadol tablets from the petitioner and other accused. Hence, the case was registered.

3. The learned counsel for the petitioner submitted that the victim was discharged from the hospital and the petitioner is in judicial custody from 09.01.2026 and he is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate re-iterated the prosecution case and submitted that all the accused were arrested and they were found in possession of 260 number of Tapentadol tablets. He further submitted that even though the victim was discharged he was not completely recovered from the ailment. Hence he opposed for grant of bail to the petitioner.

5. Considering the submission made by both sides and the gravity of offence and the quantity involved in this case, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original petition is dismissed. 02-02-2026 Index: Yes/No Speaking/Non-speaking order smn
