Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the record of the respondent in Tender notification dated 08.12.2004 in Tender No.HPC/07/2004/ PLN:009/KK issued by the respondent and quash the condition fixing the eligibility for manufacturers to participate in the tender stipulating a minimum acceptable rating of 500 KW capacity for WEG's and having a minimum of 25MW operating of the same model for the previous year and O & M contracts for not less than 3 years for a minimum of 50 MW and experience of executing turnkey projects of atleast total 200 MW capacity in India and thereby direct the respondents to receive the bid of the petitioner.
