3.It is the contention of Mr.M.L.Ramesh, learned counsel for the petitioner that the petitioner had purchased the property even prior to the institution of the suit for partition and separate possession. It is also claimed that there is no specific relief sought in the suit to set aside the particular sale deed in favour of the petitioner / appellant or to declare that such sale deed as null and void. This issue has to be examined.
