[Order of the Court was made by R.SURESH KUMAR, J.] This petition is to strike off the fifth respondent in the appeal is none other than the Insurance Company, who is the petitioner / appellant herein.

2. In fact, before the Motor Accident Claims Tribunal, even though the petitioner / appellant Company has been named as second respondent, the very same company is shown as fourth respondent and this mistake though has been agitated by the learned counsel appearing for the petitioner before the Tribunal, that error could not be rectified, therefore, he wants to strike off the present fifth respondent, who is none other than the petitioner / appellant.

3. In view of the aforestated peculiar facts and circumstances, we are inclined to allow this petition, accordingly, this petition is ordered.

Registry is directed to carry out the order of amendment by striking off the fifth respondent from the array of parties and number the main civil miscellaneous appeal, if the papers are otherwise in order.
