( Civil Appellate Jurisdiction ) Monday, the First day of March Two Thousand Twenty One PRESENT THE HON`BLE MR JUSTICE T.RAJA and THE HON`BLE MR JUSTICE G.CHANDRASEKHARAN CMP No.2226 of 2021 in CMA.No.938 of 2020 B.VIJAYA KUMAR [ PETITIONER ] Vs SMT.N.PRIYANKA [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the stay dated 12.03.2020 for further period of Four Weeks and permit the petitioner to deposit the 50 percent of the amount towards the legal expenses(in CMP.No.2226/2021) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.J.HARI KRISHNA, Advocate for the petitioner the court made the following order:- (Order of the Court was delivered by T.RAJA,J.) This petition has been filed to extend the order of stay granted by this Court on 12.03.2020 for further period of four weeks and to permit the petitioner to deposit the 50% of the amount towards the legal expenses.

2.Learned counsel appearing for the petitioner submitted that although the petitioner was ready and willing to deposit the said amount, due to the intervention of Covid-19 pandemic situation, he lost his job, as a result, he was not able to deposit the same. Now the petitioner has joined as a Delivery Executive in SWIGGY and he is prepared to deposit the same.

3.Taking note of the fact that due to Covid-19 pandemic situation followed by the lock down declared by both State and Central Government on 23rd March, there was no movement all over the country and the Hon'ble Apex Court, taking suo motu cognizance of the situation arising out of COVID-19 pandemic ordered that a period of limitation in all such proceedings irrespective of the limitation prescribed under the General Law or Special Laws whether condonable or not shall stand extended with effect from 15.03.2020 till further orders to be passed by the Hon'ble Apex Court, we are inclined to extend the stay and to permit the petitioner to deposit 50% of the amount towards legal expenses.

4.Accordingly, the interim stay granted by this Court is extended for a period of three weeks and the petitioner is permitted to deposit 50% of the amount towards the legal expenses before the IV Additional Family Court, Chennai, within a period of one week from the date of receipt of a copy of this order -sd/- 01/03/2021 / TRUE COPY / Sub-Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
