ORDER

This writ petition has been filed by the petitioner to direct the respondent to promote him as Store keeper with effect from the date, on which he was eligible as per the order of this Court in W.P.No.9895 of 1997 dated 16.11.2000 and the order of Commissioner for Milk Production and Diary Development, Chennai in his proceedings No.R.P.No17879/M1/2001 dated 05.03.2003 with all consequential benefits.

2. Earlier the petitioner filed a writ petition in W.P.No.9895 of 1997. By an order dated 16.11.2000, this Court directed the petitioner to make a representation to the respondent and also directed the respondent to consider the same and pass suitable orders. Accordingly, the petitioner made a representation to the respondent and the respondent also considered the same and rejected his claim. Challenging the same, he filed this petition.

3.The prayer sought for by the petitioner in this writ petition is to direct the respondent to consider him for vacancies arisen in the year 2003. At the time of filing this writ petition, the petitioner was 47 years. As of now, he retired from service.

4. Considering the change of circumstances, no relief can be granted to the petitioner at this stage. Accordingly, this writ petition is dismissed as infructuous. No costs.
