Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Declaration, declaring that the Tamil Nadu Motor Vehicles Taxation (Amendment) Act 13 of 2003 in G.O.Ms.No.649 dated 31.07.2003, passed by the first respondent as ultra vires of the Constitution of India, in so far as they relate to the amendment of the provisions of the Tamil Nadu Motor Vehicles Taxation (Amendment) Act 13 of 2003 substituting the rate of tax in clause 8 of the I schedule to the Principal Act by increasing the Motor Vehicles Tax in respect of the vehicles owned by the Educational Institutions from Rs.2000/- per quarter to Rs.150/- for every person (excluding the driver) which the vehicle is permitted to carry in respect of the vehicle operated by the petitioner.
