O R D E R

The petitioner, alleging non compliance of the order passed by this Court dated 10.07.2013 in W.P.No.38971 of 2004, has filed the present contempt petition.

2. The respondent Transport Corporation has filed W.P.No.38971 of 2004 challenging the award of the Labour Court in I.D.No.97 of 2002 dated 16.03.2004 and this Court, vide order dated 10.07.2013, has confirmed the https://hcservices.ecourts.gov.in/hcservices/

Cont.P.No.2802 of 2015 award passed by the Labour Court. According to the contempt petitioner, the Labour Court has directed the respondent herein to reinstate the petitioner in service with 75% back wages with continuity of service and other attendant benefits and since the said order has not been complied with, the present contempt petition is filed.

3. It is submitted by the learned counsel for the petitioner that when the matter is pending before this Court, the respondent has complied with the order passed by the Labour Court, however the respondent Transport Corporation has reinstated the petitioner on daily wage basis.

4. Mr.G.Saravanakumar, learned Standing Counsel for the Transport Corporation would submit that the order passed by this Court has been complied with and if there is any dispute with regard to payment of wages, the petitioner can move the Labour Court seeking appropriate relief.
