PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent to give police protection to the petitioner's Day Care Centre and Geriatric Clinic situated at Samyreddi Palayam, Egmore, Chennai - 600 008 based on the petitioner's complaint dated 12.12.2019. This petition has been filed to direct the respondent to give police protection to the petitioner's Day Care Centre and Geriatric Clinic situated at Samyreddi Palayam, Egmore, Chennai - 600 008 based on the petitioner's complaint dated 12.12.2019.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

The learned counsel for the petitioner has submitted that the petitioner is a Honorary Secretary of Guild of Service -NOW/MOW unit and for elders and a Geriatric clinic functioning at No.19, Rangachari Street, Samireddypalayam, Egmore, Chennai8. He further submitted that many old people are staying during the day, where food is cooked and provided for them. At the Day Care Centre (DCC) also a lot of elderly patients visit the Geriatric Clinic, they were provided free medicines for
Diabetics and Hypertension and treatment for other ailments. That apart, the volunteers and staff working for the NOW/MOW unit visit the Day Care Centre and Geriatric Clinic to take care of the aged people. He further submitted that the respondent to provide regular beat/patta pass book to the area wherein the petitioners unit premises are situated and the police also regularly came for beat up to 19.01.2020 and thereafter discontinued the said beat and hence he requests to direct the respondent to post permanent police beat and also keep permanent patta pass book to the petitioner premises. He further submitted to direct the respondent to give police protection to the petitioner's Day Care Centre and Geriatric Clinic situated at Samyreddi Palayam, Egmore, Chennai based on the petitioner's complaint dated 12.12.2019.

Per contra, the learned Additional Public Prosecutor has submitted that already respondent posted beat to the area wherein the petitioner's premises situated and one police also regularly patrolling in the said area and also signed in the patta passbook. He further submitted that if any order is passed directing the respondent to post permanent police beat in the petitioner's premises, then everyone will ask for the same kind of relief and it is very difficult for the respondent to provide police protection to all.
5. As submitted by the learned Additional Public Prosecutor, if the petitioner's request is considered for posting of permanent police beat, the other people also may ask for the same kind of relief. Hence the petitioner's request cannot be considered. Further, according to the learned Additional Public Prosecutor, already the respondent has posted two police personnel for patrolling. The xerox copy of the patta pass book shows that the police is also on the regular beat work and hence the petitioner's request cannot be accepted.
6. For the aforesaid reasons, this Criminal Original petition is dismissed.
