The Criminal Original Petition has been filed to quash the proceedings in C.No.132/CCB-TPC/2018 dated 10.07.2018 on the file of the second respondent.
2.It is seen that the request made by the second respondent dated 10.07.2018, to the Registrar, Debts Recovery Tribunal, Coimbatore, to freeze the amount of Rs.50,00,000/- deposited in the Account No.35501817388 belongs to the petitioner till the disposal of the case in Crime No.28 of 2017 registered for the offence under Sections 120 (B), 405, 406, 490, 468, 471 of IPC pending on the file of the 2nd respondent.
3.Admittedly, this petition is pending with the Debts Recovery Tribunal, Coimbatore. The petitioner has also filed a reply to the request made by the second respondent and the https://hcservices.ecourts.gov.in/hcservices/
adjudication is pending before the Debts Recovery Tribunal, Coimbatore. It is only an application made by the second respondent to freeze the account of the petitioner made to the Debts Recovery Tribunal, Coimbatore and it cannot be quashed here and the petitioner is at liberty to defend his petition before the Debts Recovery Tribunal, Coimbatore. 4.With the above observation, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition is closed.
