ORDER

This Writ Petition is filed seeking a Writ of Mandamus directing the respondents 1 to 3 to consider and dispose of the petitioner's representation dated 12.10.2023 and to sanction the Patta in the name of the petitioner within a stipulated im as to be fixed by this Court.

2. The contention of the petitioner is that he had applied for transfer of Patta before the Tahsildar along with related documents on 28.08.2023 and the same was not considered, he made a representation to the respondents on 12.10.2023 and again on 16.10.2023. But still, the same has not been considered. Hence, the present Writ Petition is filed.

3. Mr.T.Arun Kumar, learned Additional Government pleader takes notice for the respondents.

4. Though the petitioner stated that he has applied for transfer of Patta, he has not produced any document to show that he has made online application and paid the requisite fees. As per the present procedure, for transfer of patta, online application has to be made and requisite fees has to 2/5

paid through e-challan.

5. Therefore, the petitioner is directed to make a fresh application in the manner known to law as per the present procedure. On receipt of such application from the petitioner, the respondents are directed to take the application on file if the same is otherwise in order and issue notice to the petitioner and also to the rival claimants/interested parties/objectors if any as the case may be and conduct enquiry in the manner known to law and pass orders on merit and in accordance with law by following the procedures as prescribed in the circular No.R1/2005632/2022 dated 17.07.2023 issued by the Commissioner of Land Administration.

6. With the above directions, this Writ Petition is disposed of at the admission stage itself. There shall be no order as to costs. 13.02.2024 ksa-2 Index : Yes / No Speaking Order : Yes / No To 3/5
