This petition is filed to implead the proposed respondents 2 to 4 and rank them as respondents 2 to 4 in the above second appeal. The proposed parties are neither necessary nor proper for the purpose of disposal of the second appeal. The suit is only for a permanent injunction against named defendants. The suit has been decreed. The appeal has been dismissed. The defendants are on second appeal before me. It is for the plaintiff to choose who he wants to file a suit against. He has chosen not to implead the Government. It does not fall within the jurisdiction of the defendant to dictate as to who should be made as a party by the plaintiff. I find no reason. The CMP is dismissed.
Post the second appeal for final hearing on 03.04.2024.
