PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of certiorarified mandamus calling for the records relating to the order of the 1st respondent in Letter No.50032/E5/05-11 dated 15.05.2009 and quash the same and consequently direct the respondents to appoint and regularise the service of the petitioner in any one of the vacancy.

ORDER

The petitioner had filed this writ petition praying to issue a writ of certiorarified mandamus to quash the order of the 1st respondent vide a letter dated 15.05.2009 insofar as it rejected the request of the petitioner for absorption as a permanent employee.

2. It is brought to the notice of this Court that the petitioner has since been appointed as Water Reservoir Tank Operator in the Panchayat Union Commission, Mel Bhuvanagiri Panchayat Union, Jeyamkondan Village, Cuddalore District. In the light of the subsequent development, the petitioner seeks liberty to approach the respondent to regularise the petitioner's appointment to the said post. The learned Government Advocate, Mr.S.Rajesh does not have any objection to the above prayer.

3. In view of the same, the petitioner may submit his representation seeking regularisation of his appointment to the concerned authority and if any such representation is submitted, the competent authority shall dispose of the same in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order.

4. With the above directions, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
