ORDER

The Criminal Original Petition has been filed by the petitioner to direct the respondent to disburse the petitioner father's (Late) R.Gopal P.W.41 amount based upon the petition dated 13.07.2009, in C.C.No.28159 of 1976 on the file of the II Metropolitan Magistrate, Egmore, Chennai pending on the file of the respondent.

2.The learned Additional Public Prosecutor would submit that the claim petition made by the petitioner before the C.M.M.Court on 26.03.2009 in R.O.C.No.2671/06/D was returned for certain compliance.

3.It is seen from the records that the petitioner made a claim petition before the C.M.M.Court on 26.03.2009 in R.O.C.No.2671/06/D and the same was returned for certain compliance. However, the petitioner is at liberty to make a fresh claim before the II Metropolitan Magistrate, Egmore, Chennai in C.C.No.28159 of 1976. On receipt of the said claim, the learned II Metropolitan Magistrate, Egmore, Chennai is hereby directed to consider the same and pass orders on merits https://hcservices.ecourts.gov.in/hcservices/

in accordance with law within a period of four weeks from the date of receipt of the said claim petition.

4.With the above direction, this Criminal Original Petition stands disposed of.
