O R D E R

This writ petition has been filed for the issue of writ of Mandamus directing the respondent to consider the appeal filed by the petitioner on 01.09.2019 and to pass orders within a time frame fixed by this Court.

2. The case of the petitioner is that he was working in the respondent-Bank as a JMG Scale I Officer. A charge memo came to be issued against him and based on the findings in the enquiry, an order came to be passed on 30.01.2013 dismissing the petitioner from service. The appeal filed by the petitioner has also rejected on 27.06.2014. The petitioner filed a writ petition in WP.No.31375 of 2016 before this Court and this Court had set aside the order and remitted the matter back to the Disciplinary Authority.

3. Subsequent to the remand, the enquiry was again conducted and an order came to be passed on 02.08.2019 by the Disciplinary Authority, who has again imposed the punishment of dismissal from service. The petitioner, aggrieved by the same, filed an appeal before the respondent on 01.09.2019. The grievance of the petitioner is that the appeal has not been considered till date and therefore, he has approached this Court seeking for appropriate directions.

4. Heard Mr.K.Srinivasa Murthy, learned counsel appearing on behalf of the petitioner and Mr.S.Bazeer Ahamed, learned standing counsel appearing on behalf of the respondent.

5. Taking into consideration, the facts and circumstances of the case and the limited relief that has been sought for in the writ petition, there shall be a direction to the respondent to consider the appeal filed by the petitioner on 01.09.2019 and pass appropriate orders, within a period of six (6) weeks from the date of receipt of a copy of this order. The petitioner is directed to make a representation to the respondent along with the copy of this order.

6. This writ petition is disposed of with the above directions. No costs.
