This Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus to call for the records of the 2nd respondent impugned communication bearing proceedings No.703K/ED/SAO/HT/2005/78 dated 04.05.2005 and quash the same and to direct the 1st and 2nd respondents to dispose of the representations dated 22.01.2005 and 20.04.2005, made for adjusting the excess amount paid during the time of absence of Energy meter in the petitioner's Mill between 16.06.2004 to 24.12.2004 and about the defective functioning of the New Energy meter installed on 11.10.2004.

The learned counsel for the writ petitioner has made an endorsement that the petitioner may be permitted to withdraw the writ petition as not pressed with liberty to agitate the relief sought for in the writ petition in O.S.No.9 of 2007 on the file of the Additional District Judge, Puducherry at Karaikal.
