ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 28.12.2021 for the offences punishable under Sections 120B, 420, 465, 467, 468 and 471 of IPC in Crime No.236 of 2021, on the file of the respondent police, seeks bail.

The case of the prosecution is that, the petitioner along with her husband created a forged and fabricated document and obtained loan for a sum of Rs. 49,00,000/- from the bank. Hence, the complaint.

The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and she has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 28.12.2021 onwards. Hence, she prays for bail.

The learned Additional Public Prosecutor appearing for the respondent police raised objection stating that investigation is pending.

Considered the submissions made by the learned counsel appearing on either side. The respondent police registered a case as against the petitioner for the offences punishable under Sections https://hcservices.ecourts.gov.in/hcservices/

120B, 420, 465, 467, 468 and 471 of IPC. In the alleged occurrence, after fabricating the false documents, the petitioner and her husband defrauded the bank and received a loan of Rs.49,00,000/- (Rupees Forty Nine Lakhs). As of now, the petitioner is not ready and willing to deposit any amount or for settling the issues. 6.

Therefore, on considering the nature and gravity of offence committed by this petitioner, this Court is not inclined to grant bail to her. Hence, this Criminal Original Petition is dismissed.
