This Criminal Original Petition has been filed to call for records and quash the charge sheet in S.T.C.No.16 of 2023 on the file of the District Munsif cum Judicial Magistrate Court, Denkanikottai.

2. Heard the learned counsel appearing for the petitioner and the learned counsel for the respondent and perused the materials available on record.

3. Since no adverse order is passed as against the private respondent, notice to the private respondent is dispensed with.

4. The petitioners were arrayed as A1 and A2 in Crime No.231 of 2022 on the file of the first respondent/Police and after completion of investigation, they laid a charge sheet before the learned District Munsif Cum Judicial Magistrate, Denkanikottai and the same was taken on file of in S.T.C.No.16 of 2023. Pending case, the petitioners have filed this criminal original petition to quash the charge sheet. It is seen from the statement of the witnesses recorded under Section 161 Cr.P.C., there

are prima facie allegations available as against the petitioners.

5. In view of the same, The Criminal Original Petition is dismissed. However, the petitioners are at liberty to work out their remedy before the trial court by taking all their defence. Consequently, connected miscellaneous petitions are closed. 18.11.2024 mfa Index:Yes/No Speaking Order: Yes/No
