ORDER

Ms. R. Shakthi Priya, learned counsel appearing for the petitioner, submitted that the petitioner had previously filed a Criminal Revision Case for the same cause of action in Crl.R.C. No. 664 of 2024. She further submitted that

on 22.04.2025, upon a request made by the learned counsel for the petitioner to withdraw the matter, a Co-ordinate Bench of this Court was pleased to dismiss the said petition as withdrawn.

2.The learned counsel for the petitioner further submitted that she was under the impression that liberty had been granted to file a fresh petition while dismissing Crl.R.C. No. 664 of 2024 as withdrawn. However, the order dated 22.04.2025 passed by the Co-ordinate Bench did not explicitly grant such liberty, and consequently, the present revision petition was filed without securing the necessary leave of the Court.

3.In view of the above circumstances, the learned counsel stated that she does not intend to press the present revision petition. Instead, she seeks permission to withdraw this case, with an intention to file an appropriate application to recall or modify the order dated 22.04.2025 passed by the Coordinate Bench in Crl.R.C. No. 664 of 2024 to seek liberty to file a fresh petition.

4.Recording the submission made by the learned counsel for the petitioner and also considering the endorsement made in the case bundle, permission is granted to withdraw this matter.

5.Accordingly, this Criminal Revision Case is dismissed as withdrawn, with liberty to the petitioner to move an appropriate application before the Coordinate Bench for modification or recalling of the order in Crl.R.C. No. 664 of 2024 dated 22.04.2025.
