The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the second respondent to consider the petitioner's representation dated 29.01.2024 to suspend the operation of Locker No 32, State Bank of India, Walajah Road Branch, Chennai. 2.The learned counsel appearing for the petitioner submitted that the petitioner and the third respondent are wife and husband and they jointly opened a locker on 24.01.2024 in A/c.No.20178696651 in Locker No 32, State Bank of India, Walajah Road Branch, Chennai, in Key No.54 and subsequently, there was dispute between the petitioner and the third respondent and the third respondent is not cooperating with the petitioner to open the bank locker.
3.The learned counsel appearing for the respondents 1 and 2 submitted that since there is dispute between the petitioner and the third respondent, the second respondent did not allow the petitioner to 2/4
open the locker. If the third respondent cooperate with the petitioner, the second respondent will allow the petitioner and the third respondent to take all the inventories.
4.Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents 1 and 2 and perused the materials available on record. There is no representation for the third respondent.
5.Since there is dispute between the petitioner and the third respondent, and the third respondent is not cooperating with the petitioner to open the bank locker, the second respondent is directed to issue notice to the petitioner and the third respondent for the purpose of opening the locker in terms of the available Regulations of the second respondent Bank and such exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
