PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, to issue an order of direction, for speedy disposal to the learned XV Additional Judge, City Civil Court, Chennai to take up IA.No.1 of 2021 in OS.No.8673 of 2010, and to complete and conclude the final decree proceedings in OS.No.8673 of 2010 within a specified time limit that may be fixed by this Court.

ORDER

This Civil Revision Petition is filed to issue an order of direction for speedy disposal to the learned XV Additional Judge, City Civil Court, Chennai to take up IA.No.1 of 2021 in OS.No.8673 of 2010, and to complete and conclude the final decree proceedings in OS.No.8673 of 2010, within a specified time limit that may be fixed by this Court.

2. The plaintiff in the suit for partition having succeeded in obtaining the preliminary decree was filed an interlocutory application in I.A.No.1 of 2021 for passing a final decree. The petitioner now seeks expeditious disposal of the said final decree application, which is pending for more than four years. The said suit itself was instituted in the year 2010.

3. Heard the learned counsel for the petitioner.

4. In view of the limited relief sought for in this revision, notice to the respondents is dispensed with.

5. In the light of the above, I am inclined to allow the Civil Revision Petition and direct the XV Additional Judge, City Civil Court, Chennai to dispose of the application for passing final decree in I.A.No.1 of 2021 on merits and in accordance with law, on or before 31.12.2025.
