The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondent herein to consider the application submitted by the petitioner for effecting modification of entry in the Patta register on 11.04.2017 by holding an enquiry in accordance with law.

Mr.E.Balamurugan, learned Special Government Pleader takes notice for the respondent. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a mandamus directing the respondent to consider her application for effecting modification of entry in the Patta Register on 11.04.2017, by holding an enquiry in accordance with law.

3. The learned counsel for the petitioner would submit that the petitioner has submitted an application dated 11.04.2017, to correct the error occurred in the Patta issued in respect of the properties in T.S.No.47/4, Survey No.30 part, old Municipal https://hcservices.ecourts.gov.in/hcservices/

door No.13 and New Door No.37, Bharathi Street, Kamarajiapuram, Velachery, in Certificate dated 10.11.2009, by modifying an extent as 850 sq.ft. (78.05 sq.mtr) in T.S.No.47/4, Survey No.30, part, Old Municipal door No.13 and New Door No.37, Bharathi Street, Kamarajapuram, Velachery, and issue a modified certificate of Patta. Since no order has been passed, the petitioner is before this Court, by filing the present writ petition.

4. It is further submitted that there is no rival claim and if a direction is issued to the respondent to dispose of the application of the petitioner, she would be satisfied.

5. The learned Government Advocate submitted that the petitioner's application will be considered in accordance with law.

In the light of the above submissions made by the learned counsels on either side, this Court, without going into the merits, directs the respondent to consider the petitioner's application dated 11.04.2017, and pass appropriate orders on merits and in accordance with law, after providing an opportunity of hearing to all necessary parties, within a period of twelve weeks from the date of receipt of copy of this order.

7. With the above observation and direction, this Writ Petition is disposed of. No Costs.
