Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, Calling for the concerned records from the 2nd respondent, quash the charge memo bearing No.17928/650/ADM.R/R.1/2004 dated 29/31.07.2004 issued by the 2nd respondent and the second show cause notice bearing No.9020/301/ DM.B/B.1/2005 dated 8/9.05.2005 issued by the 2nd respondent and consequently direct the respondents to continue the employment of the petitioner as Assistant Engineer/Civil pursuant to the order of selection issued by the 1st respondent vide memo no.077322 R-1/94-33 dated 25.05.95. O R D E R

The learned counsel, appearing on behalf of the writ petitioner, fairly made a submission that the writ petitioner was allowed to retire from service. The writ petition was filed, challenging the charge memo dated 31.07.2004 issued by the second respondent and the second show cause notice dated 09.05.2005. The writ petitioner attained the age of https://hcservices.ecourts.gov.in/hcservices/

superannuation on 31.052014 and he was allowed to retire from service and all the pensionery and terminal benefits had been settled and now the writ petitioner is receiving his monthly pension.

2. This being the factum now submitted before this Court, no further adjudication needs to be entertained in respect of the grounds raised in the present writ petition.

3. Accordingly, the writ petition stands closed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also closed.
