...respondents Prayer:- This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus, calling for the records pertaining to the award dated 26.05.2009, passed by the 1st respondent in I.D.No.27/2007, quash the same and consequently direct the 2nd respondent to reinstate the petitioner with continuity of service, backwages and all other attendant benefits, award costs. ORDER

When the matter earlier came up for hearing, the learned counsel for the petitioner represented that the petitioner died and sought time to implead the legal representatives of the deceased petitioner. However, he is unable to file any petition till date.

2. Since the learned counsel for the petitioner is unable to predict what time he will be able to contact the legal heirs of the deceased petitioner, this Court is unable to keep this Writ Petition pending unnecessarily even after the death of the petitioner. Hence, this Writ Petition is dismissed for non-prosecution. It is open to the legal heirs of the petitioner to file a petition to give life to this Writ Petition by bringing them on record as legal representatives of the deceased.
