ORDER
This Writ Petition has been filed seeking a direction to the respondents to pay the petitioners interest for the belated payment of PF, Gratuity, Earned Leave Salary and Surrender Leave salary with interest at the rate of 15 percent p.a., within a specified time, as fixed by this Court.
2. It is the case of the petitioners that they joined the service of the first respondent Corporation on 11.03.1192 & 22.08.1990 and had retired from service on 30.06.2024 & 31.07.2024 respectively. However, their terminal benefits namely, PF, Gratuity, Earned Leave Salary and Surrender Leave salary have been settled only after 519 and 488 days belatedly.
Therefore, the petitioners claimed 15% interest on the belated settlement of retirement benefits and they have also made a representation on 24.12.2025 & 06.01.2026 respectively to pay interest for the belated settlement of retirement benefits which have not evoked any response so far. Hence, the present Writ Petition.
3. Heard the learned counsels appearing on either side and perused the materials available on record. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.
4. In view of the limited request made by the petitioners with regard to interest on the belated settlement of retirement benefits, this Court directs the respondents to pay interest at the rate of 6% p.a. for the belated payment of retirement benefits as stated supra from the date of retirement till the date of actual disbursal of the retirement benefits of the petitioners, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.
5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
6. WMP.No.4052 of 2026 filed by the petitioners to permit them to join together and file a Single Writ Petition is allowed on payment of single Court fee.
