(Crime No.14 of 2017) ..Respondent/Complainant Criminal Revision Case filed under Section 397(1) and 401 Cr.P.C. to set aside the order passed in C.M.P.No.437 of 2017, dated 10.02.2017 on the file of the learned Judicial Magistrate No.II, Tindivanam, Villupuram District and allow the petition and return of the motorcycle bearing Registration No.TN-167400, Hero Ignijor white colour, in the interim custody of the petitioner.

O R D E R

The petitioner filed a petition to return the motor cycle bearing Registration No.TN-16-7400, and it was dismissed. As against the same, the present Criminal Revision Case is filed.

2. Today, when the matter is taken up for hearing, the learned Government Advocate(Crl. Side) appearing for the respondent would submit that already the above motor cycle has been confiscated by the order passed by the Additional Superintendent of Police, REW, Villupuram District vide his Proceeding No.Na.Ka.13/confiscate/ADSP/ Vpm/2017 dated 24.02.2017.

3. In the above circumstances, since already the motor cycle has been confiscated by the authorities, the prayer sought for by the petitioner cannot be granted. However, liberty is given to the petitioner to challenge the order of confiscation.
