ORDER
(Order of the Court was made by S.M.Subramaniam J.) The Writ of Mandamus has been instituted to direct the respondents 1 to 4 to remove the encroachment made in RS.No.854/1 classified as "Nilaviyal Vandi Pathai" at Modakurichi "B" Village, Modakurichi Taluk, Erode District by considering the petitioner's representation dated 13.01.2023.
2. The learned Additional Government Pleader based on the letter sent by the Revenue Tahsildar, Modakurichi to the District Collector made a submission that the encroachments are identified. Compound wall has been constructed in the "Nilaviyal Vandi Pathai", thereby causing obstruction to the public to take the tractor, agricultural produces etc.,
3. The learned counsel for the petitioner would submit that due to the encroachment, the people using "Nilaviyal Vandi Pathai" is unable to commute their vehicle, more specifically tractors in a free manner. In view of the said obstruction, the present Writ Petition came to be instituted.
4. Since the Authorities have already identified the encroachments in the "Nilaviyal Vandi Pathai", the respondents are directed to initiate all appropriate actions to remove the obstruction / encroachment and protect the "Nilaviyal Vandi Pathai" for the usage of public at large. The said exercise is directed to be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.
