JUDGMENT

It is represented that the relief sought in the suit has been settled among the parties. A memo has also been filed. The memo is as follows:- "It is submitted that the plaintiff has received a sum of Rs.7,50,000/- (Seven Laksh Fifty Thousand only) from the Defendant vide D.D.No.129708 dated 02.03.2017 drawn on HDFC Bank, Pune Branch, Payable at R.K.Salai, Chennai, towards full and final settlement of amount claimed in C.S.No.58 of 1999.

It is prayed that the suit may be dismissed as "settled out of court".

The memo has been signed by the plaintiff and also by the counsel for the plaintiff. Endorsement has also been made in the plaint. The endorsement is as follows:- "Suit settled out of Court".

Since the matter has been settled out of the court, the suit is dismissed as "settled out of court". The plaintiff is entitled to withdraw the entire court fees.
