O R D E R

The present Criminal Original Petition has been filed to modify the condition imposed in the order dated 06.02.2017 made in Crl.M.P.No.38 of 2017 on the file of the Additional District and Sessions Court cum Special Court for E.C. Act Cases, Coimbatore.

2. It is the case of the petitioner that the Bolero vehicle, which was seized by the complainant police was ordered to be returned by the learned Additional District and Sessions Court cum Special Court for E.C. Act Cases, Coimbatore, in Crl.M.P.No.38 of 2017 by order dated 06.02.2017 on certain conditions. One of the conditions is that he shall execute a bond for a sum of Rs.2,00,000/- with two solvent sureties. Since the petitioner is not able to execute the bond of Rs.2,00,000/-, he is not in a position to avail the benefit of the said order. Hence, seeking modification of the said order, the petitioner has come up with the present petition.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

4. While passing order to return the vehicle, the learned Sessions Judge directed to execute only a bond for a sum of Rs.2,00,000/- with two solvent sureties. The said order is reasonable and does not call for any interference, and this Court is not inclined to modify the said condition and hence, this Criminal Original Petition is dismissed.
