Writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to consider the representation of the petitioner dated 30.11.2017. For Petitioner : Mr.R.Ramanlaal For 1st Respondent : Mr.R.S.Selvam, G.A.

For respondents 2 & 3 : Mr.R.Arunmozhi

O R D E R

The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the 1st respondent to consider the representation of the petitioner dated 30.11.2017.

Learned Counsel for the petitioner submitted that the petitioner was appointed as Assistant Engineer in the Municipal Administration Department on 21.06.2007 in the Scale of Pay of Rs.9300-34800-4600. Thereafter, as per her request, she was transferred to the 2nd respondent office, namely, Corporation of Chennai on 3.9.2015 and after relieving from the Municipal Administration Department on 21.09.2015, she joined the 2nd respondent office on 22.09.2015. While so, the Government issued G.O.Ms.No.297, Finance (Pay Cell) Department, dated 22.7.2013, removing the pay anomaly in the cadre of Assistant Engineer with a direction to implement the same. Since the said benefit has not been given to the petitioner, she has made a representation to the respondents 1 and 2 on 30.11.2017. But the same has not been considered. Hence, the present Writ Petition. 3.

Mr.R.S.Selvam, learned Government Advocate takes notice for the 1st respondent and Mr.R.Arunmozhi, Standing Counsel, takes notice for the respondents 2 and 3.

The learned Government Advocate appearing for the 1st respondent sought for time to consider the case of the petitioner whether she is entitled to get the benefit of G.O.Ms.No.297, Finance (Pay Cell) Department, dated 22.7.2013.

Placing on record the request of the learned Government Advocate appearing for the 1st respondent, the 1st respondent is hereby directed to consider the case of the petitioner whether she is entitled to get the benefit of G.O.Ms.No.297, Finance (Pay Cell) Department, dated 22.7.2013, within a period of four weeks from the date of receipt of a copy of this Order.
