ORDER

This Writ Petition has been filed in the nature of a Mandamus, seeking a direction against the respondent to pay the unpaid 10/11 days salary of the last retirement month with 10% interest to the petitioners.

2. The first to third and fifth to twenty third Petitioners and

Mr.K.Nagarajan, who is the deceased husband of the fourth petitioner, have joined as Conductors, STM, Helper, STRM and Drivers (hereinafter referred to as 'the employees' for short) in the years 1983-1997 in the respondent/Corporation. They had retired on attaining the age of superannuation in the years 2014-2024. It is contended that the respondents had not paid the last salary for about 10 or 11 days, depending on the date on which each one of the petitioners actually retired. It is seeking that particular salary that the present Writ Petition has been filed.

3. Mr.R.Venkatesa Perumal, learned Standing Counsel had taken notice on behalf of the respondents.

4. In such circumstances, this Court deems it fit to direct that the service records of each one of the employees and the deceased employee, if any, may be examined individually and if the employees are eligible for payment of salary, a decision in that regard may be taken within a period of four weeks from the date of receipt of a copy of this order. If any clarification is required, the employees and the legal heirs of the deceased employees, if any, may be put on notice and they may answer the said

clarification. Since there has been a delay in payment, the employees and the legal heirs of the deceased employees, if any, would be entitled to interest at the rate of 6% per annum on the amount payable till the date of disbursement from the respective dates of their retirement.

5. With the above observations, this Writ Petition stands disposed of. No costs.
