PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Certiorari to call for the records of the 2nd respondent pertaining to the grant of temporary permit in favour of the 3rd respondent under Pt.No.1178/TD/TP1/TP/2016 dated -/-/2016 to ply its stage carriage service bearing Regn. No.PY-01-CK-2480 on the interstate route Puducherry to Tindivanam (Via) Gorimedu, Killianoor, TCK Road and Tailapuram and quash the same. Heard both. By consent, the writ petition itself is taken up for final disposal.
2. The petitioner has filed this writ petition seeking to quash the order passed by the first respondent granting temporary permit to the third respondent namely the Puducherry Road Transport Corporation Limited.

Mr.A.R.Nixon, learned counsel appearing for the third respondent submits that the temporary permit originally granted had expired and the Corporation has not applied for temporary permit thereafter and that they had applied only for the pucca permit, which application is still pending consideration.
4. In the light of the fact that the temporary permit granted to the third respondent had already expired and no new application has been made by the third respondent seeking temporary permit, the writ petition is disposed of with a direction to respondents 1 and 2 not to grant any temporary permit in favour of the third respondent in respect of the subject route in future. However, this will not be a bar for respondents 1 and 2 to consider the application made by the third respondent for pucca permit. No costs. Consequently, the above WMPs are closed.
