Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for all relevant records, relating to the impugned order issued in Proceedings No.Pen.12/IV/S 235 - 1316 Rtfd / 04-05 /ADK / 196 dated Nil passed by the 5th respondent herein and quash the same as arbitrary, unreasonable, improper,
illegal, being violative of the rules and regulations and principles of natural justice and thereby direct the respondents to accept the pension proposal of the petitioner forwarded by the 3rd respondent vide his proceedings dated 30.05.2004 on sanctioning his pensionary benefits, which are all legally entitled to him without delay.

When the matter was taken up for hearing, learned Government Advocate appearing for R1 to R3 submitted that though an order of recovery has been made against the petitioner, pursuant to the death of the petitioner on 07.11.2009, no recovery was effected and that nothing survives for adjudication in this petition.
2. In view of the above submission, the Writ Petition is closed. No costs. Consequently, connected Miscellaneous Petitions are closed.
